By accessing or using Peer2Gear, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. You must be at least 18 years old to create an account and arrange pickups.

2. Account Registration

To use certain features, you must register for an account. You agree to provide accurate, current information and to keep your login credentials secure. You are responsible for all activities that occur under your account.

3. Platform Role & Limitations

Peer2Gear acts strictly as a neutral intermediary platform. We provide a space for users to discover and share gear. We are not a retail store or delivery service. We do not vet users, inspect items, or verify the accuracy of listings.

4. Condition of Gear and Assumption of Risk

Users purchase gear entirely at their own risk. By reserving an item, you explicitly acknowledge that the gear is second-hand and provided by a private seller without commercial warranties.

• For Sellers: You are solely responsible for accurately describing your gear. You must accurately list any defects, issues, or missing parts.
• For Buyers: It is your sole responsibility to inquire about the condition of the gear before purchasing. Peer2Gear cannot guarantee the functionality of any item.

5. Payments and Transactions

Peer2Gear is a free service. Any payments are handled entirely between users via external third-party links (e.g., Tikkie, PayPal). Peer2Gear does not process payments, collect fees, or facilitate refunds. All transactions are final and disputes must be resolved directly between the buyer and the seller.

6. User Content and Conduct

You are responsible for the photos, descriptions, and messages you post. By posting content, you grant Peer2Gear a non-exclusive right to display it on the platform. We reserve the right to remove any content or terminate any account at our sole discretion, without notice, for harassment, fraud, illegal activity, or violating these Terms.

Prohibited Items

You may not list stolen goods, counterfeit items, or gear that infringes on third-party intellectual property rights. We reserve the right to remove any listing or ban accounts that violate these rules.

7. Disclaimer of Warranties & Limitation of Liability

The platform is provided "as is" and "as available" without any warranties of any kind. Peer2Gear disclaims all warranties, whether express or implied, including the safety, quality, or legality of the gear shared.

To the maximum extent permitted by law, Peer2Gear and its creators shall not be liable for any direct, indirect, incidental, or consequential damages—including but not limited to equipment failure, electrical faults, injury, or death—arising from your use of the platform or the use of any gear obtained through it.

8. Indemnification

You agree to indemnify, defend, and hold harmless Peer2Gear from any claims, damages, liabilities, medical bills, or legal fees arising out of your use of the platform, the gear you sell or purchase, or your violation of these Terms of Service.
